Escalating its regulatory offensive against Big Tech, the formal investigation by the European Commission is targeting Meta. At issue is the integration of Meta AI into WhatsApp, a move regulators fear could illegally foreclose the emerging chatbot market to rivals.
Bypassing the newer Digital Markets Act, the probe will rely on traditional antitrust rules under Article 102 of the Treaty on the Functioning of the European Union (TFEU). Such a move elevates the conflict from a local Italian issue to a bloc-wide threat.
Scrutiny intensifies as WhatsApp prepares to enforce new business terms that explicitly ban third-party AI providers. If found guilty of stifling competition, the social giant could face fines reaching 10% of its global annual turnover.

From Rome to Brussels: A Regulatory Escalation
Far from being a localized dispute, the intervention by Brussels signals a fundamental shift in how the bloc views AI integration. Reports indicate the Commission views the bundling of an AI assistant with a dominant messaging app as a classic “tying” abuse.
Unlike the Digital Markets Act, which sets ex-ante rules for gatekeepers, Article 102 TFEU requires proving actual abuse of a dominant position.
Geographically, the investigation is carefully carved out. It covers the European Economic Area (EEA) but explicitly excludes Italy. This procedural nuance is designed to avoid “double jeopardy,” as the July raid on Meta’s offices remains the subject of an active national probe.
Italian regulators seized documents related to the “imposed” nature of the rollout, setting the stage for this broader escalation. Highlighting the urgency of the situation, the emergency interim measures sought by Italy reflect a fear that the market is reaching a point of no return.
The Italian Competition Authority (AGCM) warned at the time that “Meta’s violation of competition rules [is] capable of severely and irreparably undermining the contestability of the market, due to consumers’ limited propensity to change their habits, which hampers switching to competing services.”
By elevating the case to the Commission level, regulators are acknowledging that a patchwork of national responses is insufficient to address a systemic platform shift. The investigation will likely focus on whether Meta is leveraging its entrenched position in personal messaging to unfairly conquer the nascent generative AI sector.
The Mechanism of Exclusion: Closing the API
At the heart of the Commission’s concern is a specific update to the platform’s governance. Introduced on October 15, 2025, the new WhatsApp Business Solution Terms create a hard enforcement deadline of January 15, 2026. After this date, non-compliant services face immediate disconnection.
The updated terms explicitly state:
“Providers and developers of artificial intelligence or machine learning technologies… are strictly prohibited from accessing or using the WhatsApp Business Solution… when such technologies are the primary (rather than incidental or ancillary) functionality being made available for use.”
Effectively drawing a red line around the platform’s ecosystem, the clause defines “AI Providers” as developers of Large Language Models (LLMs) and generative AI. “Primary functionality” serves as the key disqualifier. If a bot’s main purpose is to provide AI assistance, it falls under the ban on general-purpose chatbots from the API.
Microsoft has already capitulated to these new rules. The company confirmed its Copilot agent will cease WhatsApp support on the January deadline. Removing Meta’s largest AI rival from its most popular communication platform, the exit leaves the field clear for its own offering.
Meta defends the restriction as a necessary measure to maintain the platform’s original utility. A company spokesperson stated in October, “The purpose of the WhatsApp Business API is to help businesses provide customer support and send relevant updates. Our focus is on supporting the tens of thousands of businesses who are building these experiences on WhatsApp.”
Critics argue this definition is arbitrary. As modern customer support increasingly relies on automated agents, the distinction between a “support bot” and an “AI assistant” is collapsing. By reserving the general-purpose AI role for itself, Meta ensures that as user habits evolve toward conversational AI, they do so exclusively within its own walled garden.
The Privacy Paradox: Security as a Moat
Meta’s primary defense rests on the technical architecture of its AI integration, specifically the Private Processing architecture unveiled earlier this year. Only a first-party integration, the company argues, can guarantee the necessary level of end-to-end security for AI interactions.
Describing the system’s capabilities, Meta’s explained in April:
“Private Processing will allow users to leverage powerful AI features, while preserving WhatsApp’s core privacy promise, ensuring no one except you and the people you’re talking to can access or share your personal messages.”
To achieve this, Meta employs a complex stack involving Trusted Execution Environments (TEEs) and Oblivious HTTP (OHTTP). By controlling the full path from the app interface to the secure enclave, Meta claims to solve the privacy/utility trade-off without exposing user data.
Framing the integration as a consumer benefit, the company emphasizes the seamless nature of the experience. As a spokesperson stated in July, “Offering free access to our AI features in WhatsApp gives millions of Italians the choice to use AI in a place they already know, trust and understand.”
However, regulators view this privacy-centric architecture as a “walled garden” tactic. By coupling the AI directly to the messaging infrastructure, Meta excludes third parties who cannot integrate as deeply into the encryption protocol.
This dynamic creates a conflict of interest, as noted by privacy concerns raised during the initial app rollout, where the platform owner becomes the sole arbiter of security.
Tension lies between the technical reality of encryption and the commercial reality of market foreclosure. While “Private Processing” may indeed offer superior security, antitrust authorities are questioning whether that security is being used as a pretext to justify a monopoly on AI services within the app.
Market Impact: The Economics of ‘Lock-In’
By leveraging its dominance in messaging, Meta is accused of artificially propelling its AI service to market leadership. Central to the case is the antitrust theory of “tying,” which involves conditioning the use of a dominant product (WhatsApp) on the acceptance of a separate product (Meta AI).
Regulators fear that pre-installing Meta AI creates an insurmountable default advantage. User inertia is a powerful force. Few consumers will seek out third-party AI tools if a “good enough” option is already embedded in their chat list. Specifically, the Italian authority flagged the danger of leveraging a massive user base to bypass standard market dynamics.
The authority noted, “By combining Meta AI with WhatsApp, Meta appears capable of channelling its customer base into the emerging market, not through merit-based competition, but by ‘imposing’ the availability of the two distinct services upon users.”
Once users build a history and context with Meta AI, switching costs become prohibitively high. Assessments will likely focus on whether this integration effectively kills the market for independent AI agents on mobile messaging platforms before they can even gain a foothold.
With the January 2026 deadline approaching, the window for regulatory intervention to preserve a competitive landscape is closing rapidly.
